DECISION & REASONS:
--An Information was lodged by Stipendiary Steward Mr J Muirhead, against Mr B Lee, driver of MISTER M alleging a breach of Rule 869(2)(a) ? Excessive use of the Whip ? when driving his horse out over the concluding stages of the race. Mr Lee admitted the breach and was present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Mr Lee hit his horse at least 21 times in the home straight.
--Mr Lee, in explanation, said that if he had not hit the horse in the manner he did, it would have finished 4th and not 3rd.
--Penalty:
--Mr Muirhead suggested the "standard" fine of $200. He said Mr Lee had no relevant breaches of the rules recorded against him.
--Mr Lee asked for as low a fine as possible.
--In fixing penalty the Committee took into account the following:

- The guilty plea. --
- The submissions of Mr Muirhead. --
- The submissions of Mr Lee. --
- No relevant breaches recorded against Mr Lee. --
- The offending was in the bottom half of the scale.
Balancing all those matters, the Committee imposed a fine of $200.
