Following race 5 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that Mr A Peard, rider of FANCYFREE, angled his mount out when not clear of PULCINELLA ridden by N Harris

DECISION & REASON:
--Following race 5 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that Mr A Peard, rider of FANCYFREE, angled his mount out when not clear of PULCINELLA ridden by N Harris. This occurred in the home straight and resulted in a check to PULCINELLA.
----Mr Peard pleaded guilty to the charge.
----Mr McCutcheon demonstrated the relevant video films and showed Mr Peard angle his mount out and in doing so take the line of PULCINELLA on his outside. Mr McCutcheon said Mr Peard was only ? to ? of a length ahead of Mr Harris when he started his outward movement. He said Mr Peard turned the horse's head outwards which severely checked PULCINELLA who was rightfully going for a gap which he was entitled to.
----Mr Peard in his statement said Mr Harris appeared to be hesitating at taking the gap, but he did acknowledge causing severe interference to PULCINELLA. He did not challenge Mr McCutcheon's evidence.
----PENALTY SUBMISSIONS:
--Mr Oatham submitted this was careless riding at the high end of the scale. He said Mr Peard had a very good record with his last transgression being 28.10.02. He also reminded the Committee of the status and the stake of the race, and that PULCINELLA was severely interfered with.
----Mr Peard said in his submission he had an excellent record and has acknowledged his responsibility.
----PENALTY:
--We agree with Mr Oatham that this is careless riding at the highest end of the scale, and accept his submission that a lengthy suspension should be imposed.
----In assessing penalty we take into account Rule 1122(2):
--"On finding a breach proved the Judicial Committee may impose any penalty provided by these Rules. In imposing a penalty provided in these Rules the Judicial Committee may have regard to such matters as they consider appropriate including:

- the status of the race; ----
- the stake payable in respect of the race; ----
- any consequential effects upon any person or horse as a result of the breach of the Rule; ----
- the need to maintain integrity and public confidence in racing." --

In fixing penalty we take into account Mr Peard's guilty plea and his excellent riding record. We believe that for careless riding of this magnitude would normally warrant a suspension of up to a month, however taking into account the mitigating factors, guilty plea and excellent riding record we reduce the period to 3 weeks. Accordingly your jockey's licence is suspended from the conclusion of racing on 15 February up to and including 8 March.
