--Stipendiary Steward Mr T TAUMANU laid an information against Junior Horseman S JONES alleging that he drove BENROMACH carelessly when shortly after the start in race 7 he drove into the back of ATTSA NICE (N CHILCOTT), causing his horse to break.

Mr Jones represented by Mr P FERGUSSON appeared initially before the hearing and admitted the charge. Due to driving commitments in the next race he was excused for the hearing and agreed this his interests be left in the hands of Mr FERGUSSON.

Mr TAUMANU in referring to video footage of the race showed Mr Jones in 4th place and trailing Miss Chilcott to simply drive into the rear of her sulky causing his horse to break for a few strides before regaining its gait. No other horse was affected and BENROMACH continued to complete the race in 5th place.

Mr Taumanu said there was no contributing factor and his opinion the incident was purely caused by Mr JONES inattention.

Mr FERGUSSON admitted that Mr Jones had struck Miss Chilcotts sulky and that this was careless. He said that only Mr Jones horse was affected by the carelessness but the horse had quickly recovered and that had not impacted on the horses overall performance.

Mr TAUMANU in submissions on penalty recounted Mr Jones extensive history of similar breaches in the relatively short time he had been driving in NZ. and sought a calender months suspension.

Mr FERGUSSON in response admitted that Mr JONES had a terrible driving record but that this offence had to be taken in context. It was a moment of inattention, the impact was on Mr Jones drive and only momentarily.

He suggested a fortnight suspension and undertook to speak to both Mr JONES and his employer Mr HERLIHY in order that his manner of driving and concerns expressed by the Stipendiary Stewards be discussed and addressed.

Mr TAUMANU in conclusion said that Mr JONES had a bright and exciting future as a driver and his will and agression properly channelled would lead to him being a top driver.

Prior to concluding the hearing I requested that Mr Jones appear before the hearing.

In the presence of Mr FERGUSSON the concerns of the Stipendiary Stewards we recounted to Mr Jones as were the undertakings given to the hearing by Mr FERGUSSON.

Mr Jones driving record was summarised for his benefit and the various penalties recounted.

In suspending Mr Jones horsemans licence for two weeks (effectively four days) from the conclusion of racing on the 4th April until after the end of racing on the 18th April I have taken into account the relatively minor nature of the breach the submissions made by both parties and the excessive level of offending by him in such a short time.
----
Mr JONES was warned in no uncertain terms that this was a final warning and should he appear before The Judicial Committee on a similar charge within the near future he would be faced with the prospect of a substantial increase in punishment
