An information was lodged by Stipendiary Steward Mr J Muirhead against Mrs L Neal driver of DR WHO, alleging a breach of Rule 869(2)(a) - excessive use of the whip - in that she used her whip excessively when driving out her horse over the concluding stages of the race.

An information was lodged by Stipendiary Steward Mr J Muirhead against Mrs L Neal driver of DR WHO, alleging a breach of Rule 869(2)(a) - excessive use of the whip - in that she used her whip excessively when driving out her horse over the concluding stages of the race.

Mrs Neal admitted the breach and was present at the hearing.

Mr Muirhead demonstrated the incident by use of the video film. Commencing just inside the last 200 metres of the race Mrs Neal struck her horse with the whip on 17 occasions continuously. She then hit the horse one more time before the end of the race.

PENALTY

--

Mr Muirhead recommended a fine of $250. He said it was not the worst case of its kind. It was the continuous use which was of concern. He said Mrs Neal had no relevant breaches of the rules recorded against her.

Mrs Neal very openly admitted her guilt and asked for any leniency that was possible.

In fixing the penalty I take into account the following matters:

  1. The guilty plea. --
  2. The clear driving record of Mrs Neal. --
  3. The submissions of Mr Muirhead. --
  4. The submissions of Mrs Neal. --
  5. The offending is in the lower half on the scale of seriousness, --
  6. The recommended starting point for penalty is a fine of $250 or one weeks suspension.

Balancing all of those matters, I impose a fine of $200.
