The Information alleges that Mr D Gedge failed to present himself in the jockey's room at least 40 minutes before the advertised starting time for the first race in which he had a riding engagement.

DECISIONS AND REASON:

The Information alleges that Mr D Gedge failed to present himself in the jockey's room at least 40 minutes before the advertised starting time for the first race in which he had a riding engagement.

Mr Gedge admitted the breach and was present at the hearing. The rule was read, and Mr Gedge acknowledged he understood it.

--

Mr Hawea told the Committee that Mr Gedge had told him he had a puncture on his way to the races and had called at the BP Service Station in Patea to have same fixed, this in his words was why he was late.

After being told this, Mr Hawea or his staff, checked with the Service Station and they said they had repaired no punctures that morning.

--

The Chairman gave Mr Gedge the opportunity to retract that statement, this he did, but could offer no reason for his late arrival.

--

Mr Hawea, when asked, said to the best of his knowledge Mr Gedge had never been charged under this rule. Mr Gedge confirmed that to be correct.

--

Mr Hawea in submissions as to penalty felt the breach warranted a substantial fine. Mr Gedge when asked made no submissions as to penalty.

The Committee when arriving at a penalty were of the view that Mr Gedge had initially tried to mislead the Stipendiary Stewards, had a cavalier attitude at the inquiry and showed no remorse for his actions, which had caused stress to the connections of the horse he was engaged to ride and had caused punters to be misinformed as to who was riding the horse, i.e. Mr Gedge was listed as the rider when in fact the horse was ridden by a replacement amateur rider.

Taking into account all of the above they (the Committee) felt a fine of $700 was an appropriate penalty.
