Following the running of Race 1, the Trax Maiden, a protest was lodged by apprentice P Bell the rider of the second placed BEN HOGAN against the winner of the race VICTORIOUS DANCER.



Following the running of Race 1, the Trax Maiden, a protest was lodged by apprentice P Bell the rider of the second placed BEN HOGAN against the winner of the race VICTORIOUS DANCER.

It was alleged that VICTORIOUS DANCER interfered with the chances of BEN HOGAN towards the end of the back straight some 900m from the finish of the race.

At the commencement of the hearing all parties were asked to identify themselves and all appropriate dividends were authorised.

--

Mr Bell elected (with the assistance of his employer Mr G Searle) to represent the connections of BEN HOGAN at the protest.

--

Mr B Herd also attended representing the trainer of BEN HOGAN, Ms Latta.

--

Mr Trotter the trainer of VICTORIOUS DANCER represented his horse.

--

When making his submission Mr Bell went to the films of the incident that he alleged occurred some 900m from the finish as the field made the end of the back straight.

--

The thrust of his submissions were that at this point in the race VICTORIOUS DANCER had moved inward and onto SNOOZULOSE and LOLLILEGS causing checks to both runners with the later coming out and into BEN HOGAN?S line of running.

It was Mr Bell's contention that he had lost some 3 or 4 lengths as a result of VICTORIOUS DANCER?S actions and as the margin at the end of the race between first and second was on one and one half lengths then this loss of ground had cost him winning the race.

Mr Trotter, when making his submission, asked the committee to pay little regard to the margin at the end of the race as he contended that his horse was not being ridden out and won the race with significant ease.

--

He believed that BEN HOGAN had had his chance to win the race as he was ridden out throughout the length of the straight and was being easily held by his horse.

--

Mr Goodwin when addressing the committee with his observations stated that notwithstanding the interference it was doubtful BEN HOGAN would have finished ahead of VICTORIOUS DANCER.

DECISION AND REASON

--

The committee finds that as the field has raced out of the back straight VICTORIOUS DANCER, who has been racing wide on the track, has moved inward and caused tightening to SNOOZULOSE and LOLLILEGS. As a consequence of this tightening LOLLILEGS has reacted by moving out and into the line of running of BEN HOGAN which has resulted in Mr Bell having to take evasive action.

It is clear that Mr Bell has had to check his mount however we are not convinced that the interference complained of was not of such significance as to warrant us to exercise our discretion as to amending the placing's.

--

At the time the interference occurred BEN HOGAN was racing in last position and it has lost, in our view, an additional 3-4 lengths as a result of Mr Bell having to check.

--

We note that from this point in the race, through to the finish that BEN HOGAN has had an unimpeded run and has been well tried without taking any discernible ground off VICTORIOUS DANCER. We also note that VICTORIOUS DANCER won the race without being ridden out.

Therefore the protest is dismissed and the placing's stand.
