Following the running of Race 8, the Rising Sun Tavern Summer Cup, M J O?Brien the Co-trainer of JOE TYLER was charged with a breach of Rule 849 (2).

--It was alleged that JOE TYLER was presented in the birdcage with incorrect saddlecloth #14 which should have been #13
--Mr O?Brien attended the hearing and admitted the breach of the rule.

PENALTY
--When presenting his submissions Mr Escott stated that the horse was presented with the incorrect number and as this was the second breach of this rule within twelve months, a fine of $200.00 be imposed.
--Mr O?Brien when making his submissions readily admitted his error and explained to the committee the circumstances, which lead, to his affixing the incorrect number to his horse.
--He stated that in order to assist the club, who had stabling issues due to running twelve races, he had agreed to stable his horses well away from the main stable block. In addition he had had bought from Westport a set of their numbers so that he would not have to travel the excessive distance to obtain the clubs numbers. He submitted that had he used the clubs numbers then, that upon requesting such, the error would have not occurred due to their checking processes.
--Mr O?Brien submitted that the error had occurred because he had inadvertently looked at Friday's book, in which JOE TYLER was listed as #14, instead of today's where he was #13
--After giving due consideration to all matters the committee finds that Mr O?Brien be fined the sum of $150.00
