Following Race 9 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr Coles alleged that near the 1200 metres LOVE IN THE DARK (J Collett) was found to check his mount sharply due to MARY’S BOOK shifting in when not the required distance clear.
Following Race 9 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr Coles alleged that near the 1200 metres LOVE IN THE DARK (J Collett) was found to check his mount sharply due to MARY’S BOOK shifting in when not the required distance clear. Miss Vance, rider of MARY’S BOOK, pleaded guilty to the charge and was represented by her employer Mr G McCrae.
--Mr M Williamson demonstrated the video films which clearly showed MARY’S BOOK move in shortly before approaching the turn out of the straight. This inward movement caused quite a sharp check to LOVE IN THE DARK (J Collett) as MARY’S BOOK was not the required distance clear. Mr Williamson said the 2 horses in front of MARY’S BROOK were clear and did contribute to the interference received by LOVE IN THE DARK.
--Miss Vance, while pleading guilty, thought DESERT LAD had come out onto LOVE IN THE DARK contributing to the interference and that she had only moved in a minimal amount.
--PENALTY SUBMISSIONS
--Mr Coles told the Committee this was Miss Vance’s first charge and believed this was really just an error of judgment as she thought she was clear when moving in. He submitted this was at the low end of carelessness. Mr McCrae said Miss Vance had commitments up to and including 30 May 09.
--PENALTY
--The Committee considered all evidence and submissions particularly the following:
--• Miss Vance’s guilty plea
• This was her first charge
• Her level of carelessness which we believe was at the low end.
Accordingly we impose a suspension on Miss Vance from riding in races from after the conclusion of racing on 30 May 09 until after the conclusion of racing on 6 June 09 (4 days).
