Following the running of Race 7, The Harvey Norman Furniture Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr P T Knowles.  The allegation being that the winner, SHALOM BROMAC (9), driven by Mr K N Larsen, raced inside the track marker line for approximately 30 metres short of the winning post.



Following the running of Race 7, The Harvey Norman Furniture Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr P T Knowles.  The allegation being that the winner, SHALOM BROMAC (9), driven by Mr K N Larsen, raced inside the track marker line for approximately 30 metres short of the winning post.

Rule 869(7B) reads that where any horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman.

Film of the incident demonstrated by Mr Knowles shows SHALOM BROMAC running home along the marker line. The marker positioned 41.9 metres from the finish is seen to be brushed by SHALOM BROMAC. The horse then appears to drift inwards between that marker and the marker positioned 20.8 metres from the finish.

In assessing accurately if in fact SHALOM BROMAC has moved inside the marker line and for what distance, the issue for the Committee is that it does not have access to a direct head on camera angle.  A compounding factor is that the 20.8 metre marker has been hit with a round to go and is now positioned dangerously angled in to SHALOM BROMAC’s path.  SHALOM BROMAC jumps this marker and continues on to the finish, brushing against the marker on the finish line and all but comes down.

Mr Larsen stated that he was aware he had brushed a marker (the 41.9 metre marker), but at that stage he was unsure of his exact line as he could not see the next marker, only becoming aware of it when his horse jumped it.  Mr Larsen maintains that is impossible to gauge accurately the distance he travelled inside the marker line, however he believes that it was not in excess of the 30 metres required under the rule.

Mr Knowles could not assist further in determining if in fact SHALOM BROMAC had travelled in excess of 30 metres inside the markers

Taking into account the marker at the 20.8 metre point not being in position as a reference for Mr Larsen to hold his line, combined with the inability to accurately assess a distance in excess of 30 metres, the view of the Committee is that there is insufficient evidence to uphold the protest which is therefore dismissed.
