Decision: Following Race 4 an Information was filed pursuant to Rule 871(1) (D) by the Informant Mr J Oatham.  He alleged that Ms N Collett allowed her mount Mill Duckie to shift outwards near the 100 metres when not sufficiently clear of Vincent Mangano who was hampered for several strides. 

Following Race 4 an Information was filed pursuant to Rule 871(1) (D) by the Informant Mr J Oatham.  He alleged that Ms N Collett allowed her mount Mill Duckie to shift outwards near the 100 metres when not sufficiently clear of Vincent Mangano who was hampered for several strides.  Ms Collett admitted the breach.

Mr Coles demonstrated the video films and showed where, at the 100 metre mark, Mill Duckie (N Collett), who was racing 2 out, moved out approximately 1 ½  - 2 horse widths and into the line of Vincent Mangano when not the required distance clear.  Mr Coles said Ms Collett stopped riding initially but then continued riding forward allowing her mount to move out.

Mr Oatham said Ms Collett had a fair record with 4 charges in the last 12 months.  He believed this was a breach in the mid range and warranted 4-5 days.

Ms Collett told the Committee she had commitments until next Saturday, 31 January.

The Committee considered all evidence and before imposing a penalty took into account the following.

  • Level of carelessness which we believe to be at the lower end.

Accordingly we impose a suspension to start after racing on 31 January and conclude after racing on 07 February 2009 (4 days).
