Decision:

At the conclusion of Race 5, the Thornbury Tavern and Wattyl Paints Maiden, a protest was lodged by Apprentice Jockey, Miss C Tetzlaff under Rule 876(1), alleging that WHODUNNIT (Z Zulkifli) who was placed fourth by the Judge interfered with ERBALBERT (C. Tetzlaff), the fifth raced horse by the Judge, approximately 50 metres from the winning post.   The Judge's official margin between the fourth and fifth placed horses was a long neck.

At the conclusion of Race 5, the Thornbury Tavern and Wattyl Paints Maiden, a protest was lodged by Apprentice Jockey, Miss C Tetzlaff under Rule 876(1), alleging that WHODUNNIT (Z Zulkifli) who was placed fourth by the Judge interfered with ERBALBERT (C. Tetzlaff), the fifth raced horse by the Judge, approximately 50 metres from the winning post.   The Judge's official margin between the fourth and fifth placed horses was a long neck.

Miss Tetzlaff used several video clips of the alleged incident (head on and side on) highlighting the inward movement of WHODUNNIT on to her horse ERBALBERT.  Miss Tetzlaff stated that her horse was still travelling well when she received a bump, and as a result stopped riding for at least two or three strides, costing the horse half to three quarters of a length in her opinion.

Mr Pitman supported Miss Tetzlaff's statements.

Mr Zulkifli (Jockey WHODUNNIT) admitted his horse had moved inwards, and that he had come in contact with ERBALBERT. Miss Hoffman (Co-trainer of WHODUNNIT) supported Mr Zulkifli.

Mr Zulkifli, when questioned, confirmed that he had to stop riding his horse and that his horse was finishing on at the conclusion of the race.  Stipendiary Steward, Mr S Ching when given the opportunity stated, in his opinion, contact had been made between the fourth and fifth placed horses, and in his opinion Miss Tetzlaff has had to stop riding for at least two strides, and that has affected the chances of ERBALBERT.

DECISION/REASON:

The protest was upheld with the fifth placed horse by the Judge ERBALBERT being promoted to Fourth Placing.

--

The Committee was satisfied that there had been noticeable inward movement from WHODUNNIT onto ERBALBERT, causing Miss Tetzlaff to stop riding ERBALBERT for at least two strides. 

--

The margin of a long neck between the fourth and fifth placed horses was also significant and critical in the Committee's decision.
