FACTS:

--

An Information was lodged by Stipendary Steward Mr JM Muirhead alleging that Trainer C Dalgety was late notifying a change of gear for Bettor Move It from an open bridle to pull down blinds.

Mr Dalgety admitted the breach and advised this Committee that he did not wish to be present at the Hearing.

--

Mr Muirhead advised this Committee that the notification from Mr Dalgety was very late and was an inconvenience to the betting public.

--

The charge having been admitted is accordingly proven.

--

PENALTY SUBMISSIONS:

--

Mr Muirhead submitted that Mr Dalgety should have complied with the notification time limit in the Rule in any event but it was even more so because this was a Premier Race Meeting.   The very late notification meant that it was necessary to make extra efforts to notify the betting public.   Mr Muirhead submitted that a fine of $200.00 would be appropriate.

PENALTY REASONS:

--

In assessing penalty this Committee takes note of the evidence provided by Mr Muirhead and also the fact that Mr Dalgety has admitted the breach.   Mr Dalgety does have a number of breaches of Rule 865(4) which relates to notification of gear and he accordingly would have been very aware of his responsibilities.   He has failed to notify by the correct time and he was aware that he had to notify the change of gear because he did so very late.

PENALTY:

For the above reasons this Committee imposes a fine of $200.00 on Mr Dalgety.
