Following the running of Race 10, The Southern Trust Handicap, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Miss A J Chesmar, the rider of KIWI COURAGE in the Race, alleging that Miss Chesmar rode carelessly
| -- DECISION AND REASONS: --Following the running of Race 10, The Southern Trust Handicap, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Miss A J Chesmar, the rider of KIWI COURAGE in the Race, alleging that Miss Chesmar rode carelessly in that she allowed her mount to move outwards when not sufficiently clear causing ROCKEUR (S McCann) to check and also inconvenience LITTLE CRACKER (L M Robinson) with approximately 200 metres to run. ----Mr Ching had Mr M G Humphries, Assistant Stipendiary Steward, show the incident on side-on and head-on video replays. Mr Humphries pointed out Miss Chesmar's mount racing on the fence in behind the leader shortly after turning for home with Mr McCann's mount behind her. He then pointed out Miss Chesmar shift outwards to come around the leader and cause Mr McCann to check. Mr McCann was forced out on to LITTLE CRACKER. The head-on video showed that Miss Chesmar made a quite significant outward movement. ----Mr Ching said Miss Chesmar had completed her apprenticeship some 8 months ago and had only once previously appeared before a Judicial Committee ? on an excessive use of the whip charge. Mr Ching submitted that Miss Chesmar had not realised that Mr McCann was on her quarters and had pulled out under his mount's neck forcing him to take evasive action and inconveniencing LITTLE CRACKER. Rider safety had been compromised, Mr Ching submitted. Despite Miss Chesmar's good riding record, a term of suspension was appropriate, Mr Ching said. ----Miss Chesmar declined the opportunity to make any submissions to the Committee. She accepted that her error was clear from the video replays. ----Miss Chesmar informed the Committee of her upcoming riding engagements. ----In determining penalty, the Committee took into account the following matters: --
-- -- -- -- Having regard to all matters, the Committee suspended Miss Chesmar for a period commencing after the close of racing today up to and including Sunday, 24 October 2004, effectively, 2 riding days. The Committee allowed a discount to Miss Chesmar of one day for her admission of the breach and her previous good record. ----
