Mr Gibson admitted a breach of Rule 508(2) in that being the trainer of I’M BLAKE and JAYZEE in race 1, HILL TO HILL in race 4, and POLYGRAPH in race 6, he failed to declare jockeys by the required time. We thus find the charge proved. Mr Gibson indicated he did not wish to be present at the hearing of the information.
----Mr Davidson prosecuted the breach on behalf of Mr Ching. He stated that Mr Gibson was approximately an hour and a half late in declaring riders. He indicated that Mr Gibson had 2 breaches of this rule in the previous 13 months. He asked for a fine of $50 per horse.
----We are aware that $50 per horse is the "standard fine" for a breach of this rule, and we fine Mr Gibson the sum of $200. However, Mr Gibson needs to be told in no uncertain terms that as a repeat "offender" he needs to be aware that future Committees may decide that this level of penalty is not proving to be adequate to ensure that he complies with his obligations under the Rules of Racing.
