Following the running of the Skywards Duty Free Special Conditions Handicap Mr N. Goodwin, Stipendiary Steward, lodged a protest alleging the second placed horse, CASUALLY (S. Collett), had caused interference at about the 300 metres to GRAND CANYON (H. Tinsley) which finished third.

Following the running of the Skywards Duty Free Special Conditions Handicap Mr N. Goodwin, Stipendiary Steward, lodged a protest alleging the second placed horse, CASUALLY (S. Collett), had caused interference at about the 300 metres to GRAND CANYON (H. Tinsley) which finished third.

The margin second to third was a short neck.

At the hearing Mr G. Barlow trainer and part owner, and Mr Tinsley represented the GRAND CANYON interests’. CASUALLY’S connections were represented by Mr J. Stenning and Ms Collett.

Mr Goodwin invited Mr C. George (Chief Stipendiary Steward) to interpret the head and side on films of the final 400 metres. His analysis was that at about the 300 metres CAUSALLY, when vying for the lead, shifted out and dictated SECRET MAGIC (M. Walker) into the rightful running line of GRAND CANYON. He believed Mr Tinsley had to stop riding and shift ground before rebalancing GRAND CANYON which then took considerable ground off CASUALLY in the run to the line. Mr George believed GRAND CANYON was barely a length in arrears of CASUALLY at the point of interference but lost almost a length as a consequence. Noting the margin of a short neck between the two at the finish he considered the interference had cost GRAND CANYON the chance of a higher placing.

Mr Tinsley agreed with Mr George’s analysis and confirmed he had to put away his whip and change ground as a result of SECRET MARGIN taking his line. Mr Barlow believed the interference had cost his horse a winning chance.

Mr Stenning did not think Mr Tinsley had stopped riding or that GRAND CANYON had been unduly hampered.

Ms Collett acknowledged her horse had rolled out but she considered she corrected him before any damage of consequence occurred to other horses.

The Committee considers that the films clearly show CASUALLY move out and dictate SECRET MAGIC across the running line of GRAND CANYON. Mr Tinsley was forced to change ground and his horse lost some ground and momentum as a consequence. GRAND CANYON finished strongly and was closing quickly on CASUALLY at the line. We find that the interference affected GRAND CANYON’s chances.

In considering whether to exercise our discretion to relegate CASUALLY we have taken into account the extent of the interference, the momentum and ground lost by GRAND CANYON, the proximity to the finish of the interference, the manner both horses finished out the race and the margin between the horses at the line. We believe that GRAND CANYON lost at least a length as a consequence of the interference and had to be rebalanced at a crucial point in the race. Once wound up he was finishing over the top of CASUALLY and was quickly taking ground off that horse over the last 50 metres. It is beyond doubt GRAND CANYON’s chances of a higher placing were affected by the interference and we therefore uphold the protest and direct that CASUALLY be relegated to third and the dividends and stakes be paid accordingly. The amended placings are:
