At the outset of the hearing Ms Puha confirmed that the breach was admitted.

The Stipendiary Stewards said that Ms Puha over the last 300 metres of the race and said that she hit the horse or cart approximately 28 times. Video evidence was shown to the Committee by the Stipendiary Stewards which confirmed the number of hits and the whip of action used by Ms Puha. The charge is, accordingly, found proven.

The Stipendiary Stewards indicated that Ms Puha had no previous convictions under this rule over the last 12 months and sought a monetary penalty only. Ms Puha asked that a monetary penalty only be imposed.

The Committee after giving consideration to the submissions of both parties, and taking into account Ms Puha’s early guilty plea and her good record, agrees that a monetary penalty only be appropriate and accordingly Ms Puha is fined the sum of $200.00.
