Decision:
Following the running of Race 5, the Airport Bookshop 2yo Mobile Pace, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mrs M. L. Price, Open Horseman, alleging a breach of Rule 847(1) and the “Safety Gear” Regulation, in that she failed to wear a safety vest when checking her horse “Dana Mac” (6) out for this race.

Following the running of Race 5, the Airport Bookshop 2yo Mobile Pace, an information was filed by Stipendiary Steward Mr N. G. McIntyre against Mrs M. L. Price, Open Horseman, alleging a breach of Rule 847(1) and the “Safety Gear” Regulation, in that she failed to wear a safety vest when checking her horse “Dana Mac” (6) out for this race.
--Mrs Price had indicated on the information that she admitted this breach of the Rules, and she agreed that she understood the charge and the Rule it was brought under. The Rule provides that no horseman shall be checked out unless he or she wears safety gear which complies with the requirements of the “Safety Gear” Regulation made by the Executive.
--Stipendiary Steward Mr N. M. Ydgren gave evidence that he observed that Mrs Price was not wearing a safety vest after she had checked her horse out for the race. On being asked Mrs Price agreed that this was so.
--In explanation Mrs Price said that she had removed her safety vest after driving in Race 2, and that she had then forgotten to put it back on. The safety vest was put on before the start of the race.
--Penalty:
--Mr McIntyre advised that Mrs Price had no relevant previous convictions, and recommended a fine of $400-00. Mrs Price had no relevant submissions to make with regard to penalty.
--We adjourned to consider the matter of penalty. We were satisfied that there have been similar cases recently where a fine of $400-00 has been imposed for a breach of this Rule, and that a fine of this amount was appropriate in this case.
--On returning to the Enquiry Room we advised the parties that Mrs Price would be fined the sum of $400-00.
