Decision:

Following Race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendary Steward Mr A Coles that defendant T Harris angled his mount BURLESQUE outwards near the 400 metres when not sufficiently clear of THE RIVER (K Hercock) who was checked.



Following Race 9 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendary Steward Mr A Coles that defendant T Harris angled his mount BURLESQUE outwards near the 400 metres when not sufficiently clear of THE RIVER (K Hercock) who was checked.

Mr Harris admitted the charge.

Mr J Oatham demonstrated the head and side on videos.  He showed where, soon after entering the front straight, Mr Harris on BURLESQUE was racing on the inside of Miss Hercock riding THE RIVER.   Mr Harris then moved his mount out for a run. In doing so he took the line of THE RIVER and Miss Hercock had to check her mount. Mr Oatham did say that BURLESQUE was a first starter and may have over reacted when Mr Harris tried to ease his way out.

As Harris had admitted the charge the committee is required to adjudicate on penalty only.

Mr Coles gave Mr Harris’s record which showed 1 suspension this year. He also said that he felt that Mr Harris may have been inconvenienced by his mount being a bit green. He asked for a suspension in the 4 - 5 day range.

Mr Harris said that he had confirmed rides on 29 November and also said that he was intending to continue riding in the South Island when possible.

The committee feels that Mr Harris offence deserves a 5 day suspension. That is before taking into account

3.         He would miss a Premier day

4.         His mount, being a first starter, could have over reacted.

After taking these matters in to consideration we suspend Mr Harris from race riding beginning after the conclusion of racing on 29 November till the conclusion of racing on 5 December 2008 (4 days).
