Following the running of Race 6, the NZ Greenshell Mussels Handicap Trot, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr J. P. Wheeler alleging a breach of Rule 869(2)(a), excessive use of the whip.  The charge was that Mr Wheeler used the whip excessively on “Yankee Nova” in the run home.



This matter was heard at Addington Raceway on 21 November 2008, having been adjourned from 7 November 2008.

Following the running of Race 6, the NZ Greenshell Mussels Handicap Trot, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr J. P. Wheeler alleging a breach of Rule 869(2)(a), excessive use of the whip.  The charge was that Mr Wheeler used the whip excessively on “Yankee Nova” in the run home.

Mr Wheeler had indicated on the information that he admitted this breach of the rules and he confirmed this at the hearing. He also agreed that he understood the charge, the Rule it was brought under, and the “Use of the Whip” guidelines.

Stipendiary Steward Mr Renault used video coverage to show that Mr Wheeler had used his whip on about 27 occasions in the run home.  Mr Wheeler did not dispute the facts of the matter.

In relation to penalty Mr Renault advised that Mr Wheeler had a previous conviction for a breach of this Rule on 4 October 2008 when he was fined $200-00.  A fine of $400-00 or a two day suspension was recommended.  Mr Wheeler said that he preferred a suspension.

Taking into account Mr Wheeler’s guilty plea, and his previous conviction, we were satisfied that a two day suspension was appropriate in is case.  Accordingly Mr Wheeler’s horseman’s licence was suspended from the completion of racing tonight, 21 November 2008, until after the completion of racing on 4 December 2008, which is two day suspension.
