----Mr J. Abernethy admitted a charge of excessive use of the whip under rule 869(2)(a) in relation to his drive on CHROMEAZONE in the Lion Foundation Mobile Pace. Mr P. Butcher assisted Mr Abernethy at the hearing. Mr Taumanu used the film of the final 200 metres to assert that Mr Abernethy struck his horse 31 times without relief. He advised that Mr Abernethy's use of the whip inclines to be injudicious and he had previously been fined $175 in relation to a similar charge on 5 August 2005. He called for a fine or short suspension. Mr Butcher asked that note be taken of Mr Abernethy's admission of the charge and submitted that a fine was preferable.
----Mr Abernethy was sternly reminded that if his use of the whip did not improve he would be spending some time on the sideline. Notwithstanding his admission of the matter the failure to offer any relief to his horse demands a firm response. He is fined $300.
