Rule 864 (2) (d): Following the running of race 7 an information was lodged by the Stipendiary Stewards against Mr W Higgs the trainer of Red Hot Hat alleging that the nearest boring pole on the horse came adrift during the running.

At the outset of the hearing the Committee noted that Mr Higgs admitted the breach and did not wish to appear.

The breach is accordingly found proven.

The Stipendiary Stewards showed the video evidence of the incident and asked the Committee to consider the following matters:

· The gear was in good order
--· It was a case of strict liability, and
--· The danger involved to other drivers and horses in the race
----
It was clear from the video evidence in the run home that the boring pole came adrift and was seen lying on the track.
----
In respect of penalty the Committee was advised by the Stipendiary Stewards that they sought a monetary penalty only and that Mr Higgs had no similar breaches in the last year.
----
Giving consideration to the information provided to the Committee Mr Higgs is fined the sum of $100.
