Following Race 2 an Information was filed pursuant to Rule 605 (1).  The Informant Mr Coles alleged that Mr Holmes failed to present himself on course to ride READY TO DEAL by the required time.

FACTS:

--

Mr Coles explained to the committee that Mr Holmes arrived too late to fulfil his engagement in Race 2 and had to be replaced.  Mr Coles said Mr Holmes had explained to him that there had been a misunderstanding between his brother and himself over the race times today and tomorrow which led to his late arrival.

Mr Holmes confirmed this evidence to the committee and had nothing further to add.

SUBMISSION(s) ON PENALTY:

Mr Coles submitted a fine of $100 - $200 would be appropriate.  Mr Holmes had nothing to say on penalty.

REASON(s):

--

The committee considered the evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Holmes’s guilty plea and his honesty and cooperation with the stewards.  However, as explained to Mr Holmes, this breach constituted a broken riding engagement resulting in an inconvenience to punters and connections.

Accordingly we impose a fine of $200.
