An information was lodged by Stipendiary Steward Mr T Taumanu against Horseman T MacFarlane alleging he drove Mobile Skipper carelessly
| -- RACE NO: 1 INFORMATION NO: 65439 RULE NO: 869(3)(b) ----An information was lodged by Stipendiary Steward Mr T Taumanu against Horseman T MacFarlane alleging he drove Mobile Skipper carelessly striking the sulky of Morpheus (J Robinson) resulting in interference to both these horses and in severe checks to Whodatdere (I Brownlee) and Fobwatch (A Neale) --Mr MacFarlane did not admit the breach and was present for the hearing --Evidence was given by the Stipendiary Stewards supported by Video tapes of the incident at approximately 500 metres after the start,which showed the horse Mobile Skipper striking its front foot agaist the sulky of Morpheus resulting in the front left leg becoming entangled in the sulky of Morpheus. --Both Horses were brought to a halt with the foot still entangled resulting in severe checks to Whodatdare and Fobwatch. --Further evidence was given by Driver J Robinson of him coming around the bend after the start improving three wide before dropping in to two wide when the horse infront Caballero (A Donnelly) came off the fence infront of him causing him to take hold of his horse slightly. The racing conditions were normal but then he felt a horse behind him hit his left hand wheel before the leg became entangled in the rear of his sulky. He was surprised as he had seen (Caballero) move out and had just moved up on her back. He admitted that the speed of his drive may have changed slightly but not unusually within the context of the race. --Driver T Mitchell(Quick Money) gave evidence of following Morpheus three wide. Mystery Sands (M White) --dropped down onto the fence followed by Morpheus who came across and dropped down infront of Mobile Skipper. At the time Mitchell was trying to to ease McFarlane inwards as there was no one inside. Mitchell thought that Mr MacFarlane was unlucky with his drive taking a large stride immediately before striking the rear of Robinsons sulky. He considered his actions a normal manoevre in trying to force MacFarlane down as there was room for him to move. Mr Mitchell did not notice any appreciable slowing down by Mr Robinson --immediately prior to the collision He did not consider Mr MacFarlane to be travelling too close to Morpheus and considered him to be unlucky to have his horse strike the sulky. --Mr Mitchell agreed that Mr MacFarlane may not have been concentrating so much on Morpheus as what was going on because he was trying to keep Mr Mitchell out as Mr Mitchell inturn was trying to force him down. --Following submissions from both parties I found the charge had been established in that Driver T Mac Farlane had been careless which had resulted in the collision between Mobile Skipper and Morpheus. --The carelessness was at the lower end of the scale and was most likely as a result of the contest between driver T Mitchell and him immediately prior to the collision. However the ongoing effects in causing both Morpheus and Mobile skipper to lose all chances as well as the severe checking of Fobwatch and Whodatdare had a major impact on the race --Penalty --Following submissions on penalty from both parties and taking into account the driving record and experience of Mr Mac Farlane he was fined $350.00 |
