Decision: Following the running of Race 3, Eureka Trust Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr C D Thornley, alleging a breach of Rule 869 (3) (b) in that, as the driver of SMOKEY HOBBS, Mr Thornley “drove carelessly when shifting out onto ISLAND OF ROSES (A L Jenkins) resulting in SMOKEY HOBBS breaking”.
DECISION AND REASONS:
Following the running of Race 3, Eureka Trust Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr C D Thornley, alleging a breach of Rule 869 (3) (b) in that, as the driver of SMOKEY HOBBS, Mr Thornley “drove carelessly when shifting out onto ISLAND OF ROSES (A L Jenkins) resulting in SMOKEY HOBBS breaking”.
Mr Thornley had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Mr N G McIntyre, Stipendiary Steward, showed a video replay of the relevant part of the Race (with approximately 700 metres to run). Mr Escott pointed out Mr Thornley driving SMOKEY HOBBS, near the rear of the field and on the inside. At that point, Mr Thornley endeavoured to push out, was unsuccessful and his horse broke.
--Mr Thornley had no recent breaches of the careless driving Rule. Mr Escott recommended a fine of $200. He said that the breach was at the lower end of the scale and no other runner was affected.
--The Committee, in determining penalty, had regard to Mr Thornley’s admission of the breach and his previous good record. The Committee agreed with Mr Escott that the breach was at the lower end of the scale of carelessness and noted that no other runner in the Race was affected.
--Mr Thornley was fined the sum of $200.
