This is a protest by Mr Knowles, Stipendiary Steward, against the 3rd placing of TOP HONOUR in Race 1 on the grounds that that horse interfered with NO WAY SIMON and SUN OF ZOLA at the start. He is seeking relegation under rule 869(8). Judge's placings were: 12, 15, 10, 7.

Mr Knowles has demonstrated on the videos his belief that TOP HONOUR came down approximately 1/2 a cart width just after the start of race 1 crowding NO WAY SIMON causing that horse to break and come into contact with SUN OF ZOLA which also broke.

Mr Knowles called Mr Beck, driver of NO WAY SIMON, who gave evidence that TOP HONOUR had come down 1/2 a cart width just after the start at which time NO WAY SIMON also broke. He said there was never any contact with TOP HONOUR and that he believed his horse had broken independently of the movement from TOP HONOUR. He said he called out to Mr Hay to give him room.

Mr Knowles also called Mr Norman, driver of SUN OF ZOLA, who gave evidence that there was contact between NO WAY SIMON and the stay of his cart which caused SUN OF ZOLA to break. He said there was no movement from his inner which contributed to this.

Mr Hay demonstrated on the videos that SUN OF ZOLA had moved out slightly contributing to the incident. Mr Beck agreed with Mr Hay that this was the case. He confirmed for Mr Hay that there had never been any contact with his horse and TOP HONOUR.

I am satisfied after viewing the videos and hearing Mr Beck and Mr Hay that there was no contact between TOP HONOUR and NO WAY SIMON. I find TOP HONOUR did move down about 1/2 a cart width at the time NO WAY SIMON broke. But I place weight on Mr Beck's statements that NO WAY SIMON was going to break anyway and that his horse broke irrespective of the movement from TOP HONOUR. I also agree that SUN OF ZOLA did move out slightly which contributed to the general tightening. In these circumstances I do not find that TOP HONOUR interfered with NO WAY SIMON or SUN OF ZOLA and I dismiss the protest. The placings are as the horses crossed the line.
