Following the running of Race 5, the Vosne Romanee Cup, Mr. C. Johnson admitted a breach of Rule 638 (1) (d) in that as the rider of ONE COURT CAT he allowed his mount to shift inward near the 800m when not clear of PLATINUM DANCER causing a check to that runner.

Mr. Goodwin showed a film of the incident taken from the 800m tower. He pointed to the stage of the race where Mr. Johnson was in a position in front of and to the outside of rider Mr. D. Bradley.  Approaching the bend Mr. Johnson could be seen looking to his inside hoping to gain a run closer to the fence. He then allowed his mount to move inwards but as he did he was not the required distance clear of Mr. Bradley who received a check.

Mr. Johnson said at the time he changed ground he thought he was the required distance clear of Mr. Bradley but having seen the film accepts that he was not.

Mr. Goodwin said that Mr. Johnson gets many rides all around the country and his record is very good:

The stewards did not consider this breach to be at the top end of the scale as Mr. Bradley’s horse was over-racing at the time and this made the check look worse than it was.

Mr. Goodwin’s submitted that a four day suspension was appropriate.

--

Mr. Johnson advised the committee that he had commitments to ride at Riccarton on Saturday April 24th.

DECISION & REASONS

The committee carefully considered all of the submissions presented and took into account Mr. Johnson’s ready admission of the breach.

--

 

--

The films showed Mr. Bradley’s horse receiving quite a severe check however we accept the evidence from the Stewards that his mount was over-racing at the time and contributed to the amount of ground lost as seen on the side-on film.

--

The video evidence pointed to Mr. Johnson being very close to the required distance clear when he moved ground inwards therefore we believe the degree of carelessness can be classified as towards the lower end.

--

 

--

In light of the number of rides that Mr. Johnson has had throughout the season we consider his to be a very good record.

--

 

--

Balancing all of these matters and taking into account Mr. Johnson’s immediate riding commitments he is suspended from the close of racing on Saturday April 24th until the close of racing on Friday April 30th – in effect four days.
