Decision: Following race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant Mr J Oatham that THE COLONEL (J Jago) shifted in when not sufficiently clear
Following race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant Mr J Oatham that THE COLONEL (J Jago) shifted in when not sufficiently clear causing a check to SHOWILEO (T Harris) near the 300 metres.

Mr Jago admitted the charge.

Mr Coles demonstrated the video films and showed where, soon after entering the straight, THE COLONEL ridden by Mr Jago, appeared to be hanging in. At this stage THE COLONEL was approximately ¾ length clear of SHOWILEO on the inside when he moved in taking that horses line and causing rider Mr Harris to check his mount quite sharply. Mr Coles said Mr Jago changed his whip to the other hand to try to correct THE COLONEL from hanging and this was when he moved in causing the interference.

Mr Jago, while admitting the charge wondered whether the stalls on the outside of the track caused his mount to move in. He added he was also having trouble with his mount hanging.

Mr Oatham conceded that while there were mitigating factors in Mr Jago’s favor, namely that THE COLONEL was hanging he believed Mr Jago could have done more. However he submitted the penalty should be at the lower end of carelessness.

Mr Jago, when asked of his commitments in the next 7 days said he had no firm engagements.

The committee considered all submissions and before imposing penalty took into account the following

1/ Mr Jago’s guilty plea and his cooperation.

2/ His excellent record

3/ Mitigating factors namely the hanging tendency of THE COLONEL

Accordingly we impose a suspension to start after racing today 11 July and conclude after racing on 19 July 2008. (4 days)
