Stipendiary Steward Mr Ching has filed an information requesting a ruling as to whether Licensed Trainer Mr P. D. J. Harris should be permitted to change the rider for his horses “Apachee Chief” (6) and “Salazar” (11) in Race 9, the Geoff Williams Memorial Rating 90.
--The Information reads as follows.
--“I, the abovenamed informant hereby apply to the Judicial Committee and seek a ruling on the following matter: Rule 520(3) - That Trainer P. Harris requests that he be given permission to change the rider of both Apachee Chief & Salazar from the declared riders of T. R. Mosely and P. Holmes on the respective before mentioned horses, in Race 9.”
--Rule 520(3) reads as follows.
--“(3) Any dispute with reference to the engagement or engagements of a Rider to ride in a particular race meeting or race meetings shall be determined by a Judicial Committee at the request of a Stipendiary Steward or any of the parties to the dispute.”
--Mr Ching said that Mr Harris had approached him before the first race and advised that Jockey J. Laking had not attended the meeting as he was unwell, and he was down to ride “Apachee Chief” (6). Mr Harris said it was his intention to scratch one of his other horses (“Salazar” (11)) from the race, and that he would then be able to have Jockey P. Holmes ride “Apachee Chief”. However this morning Mr Harris decided not to scratch “Salazar”. The position now was that Mr Harris wanted Mr Holmes to ride “Apachee Chief”, and for another jockey to take the ride on “Salazar”.
--Mr Harris said that he wanted Mr Holmes to ride “Apachee Chief” as it was a difficult horse to ride, and that Mr Holmes had been riding it in track work. His intention was to have Mr Holmes ride “Apachee Chief” and to scratch “Salazar”. However due to the track conditions he decided to leave “Salazar” in the field. When it came time this morning to declare riders, he needed to name a rider for “Apachee Chief”, and as Jockey Mr T. Moseley’s horse had been scratched he named him as the rider for “Apachee Chief”. Mr Harris later had second thoughts about this move.
--Mr Harris also said that both horses are hard to ride, and that “Apache Chief” is particularly difficult, and that this is the reason he wants to make the changes. Mr Harris agreed that Mr Holmes had always been the named rider for “Salazar”.
--In summing up Mr Ching said that the betting public would believe that Mr Holmes would be riding “Salazar” and that the situation should stay that way. Also Mr Moseley was a senior and very competent jockey and that he did not have any qualms about his ability to handle “Apachee Chief.”
--After hearing the evidence we adjourned to consider our decision.
--We were not satisfied that there were any valid reasons for changing jockeys on the two horses concerned. In particular we took into account that Mr Holmes had always been the designated rider for “Salazar”, and that the betting public would be misled if a change was made at such a late stage. We decided that the jockeys should remain as they were.
--On resuming the hearing we advised the parties of our decision.
