Following the running of Race 1, The Rock Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr R J Butt, alleging that Mr Butt, as the driver of ARTOIS in the Race, “used his whip excessively in the run home”.

DECISION AND REASONS:
Following the running of Race 1, The Rock Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr R J Butt, alleging that Mr Butt, as the driver of ARTOIS in the Race, “used his whip excessively in the run home”.
Mr Butt had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
Mr Ydgren informed the Committee that Mr Butt, a Junior Driver, had waived his right to be assisted by a senior horseman before pleading to the charge.
--Mrs K R Williams, Stipendiary Steward, showed to the Committee a video replay of the final 300 metres of the Race. She pointed out Mr Butt on ARTOIS improving round the field and challenging out wide. In the final 200 metres, Mrs Williams alleged, Mr Butt used his whip on some 18-19 occasions in the run to the finishing line, finishing in 2nd placing. In addition, there were several uses of the whip that were “fake”, which made the incident look even worse, Mrs Williams said. To use the whip on 18-19 occasions was too much, Mrs Williams submitted.
--Mr Ydgren informed the Committee that Mr Butt had clear record as far as breaches of the whip Rule was concerned. He recommended a fine of $200.
--The Committee, in determining penalty, took into account Mr Butt’s admission of the breach and his previous good record.
--Mr Butt was fined the sum of $200.
