Decision: Following race 5 an Information was filed pursuant to Rule 876 (1) D by the informant Mr. A. Coles.  He alleged that Fistral Bay placed 1st by the Judge interfered with the chances of Josun placed 2nd by the Judge.  This was alleged to have occurred in the concluding stages

Coles.  He alleged that Fistral Bay placed 1st by the Judge interfered with the chances of Josun placed 2nd by the Judge.  This was alleged to have occurred in the concluding stages. The margin between 1st and 2nd was a nose at the post.

Present at the enquiry were:

Fistral Bay connections – Mr. S. Clotworthy – Trainer and Miss S. Spratt – Jockey.

Josun:  Ms L. Poulson – Trainer and Mr. L.Innes – Jockey.

Mr. S. Ching Stipendary Steward demonstrated the video films and showed where at approximately the 100 meter mark Miss. Spratt rider of Fistral Bay, allowed her mount to move out into the line of Josun (L.Innes) who was moved out approximately three horse widths.

Ms. Poulson when asked had nothing further to add.

Mr. Innes, rider of Josun, said it was clear on the film that he received a bump which he said cost him one length.

--

Mr. Clotworthy, trainer of Fistral Bay said it was hard to say if there was any contact and with winter racing this was sometimes unavoidable.  He said neither rider stopped riding.

Miss Spratt, rider of Fistral Bay, said Mr. Innes contributed to the interference by moving in and putting her mount off stride.

--

Summing up Mr. Coles acknowledged that Josun moved in slightly but that was before the outward movement from Fistral Bay and the resulting contact.  He said the Committee had to weigh up the nose margin at the post and that Mr. Innes had come from a length behind Miss Spratt.

DECISION:

The Committee carefully considered all evidence and reviewed the video films.  We are satisfied that Josun did receive interference at the 100 meter mark when Fistral Bay  moved out and made contact, forcing him out approximately three horse widths.

--

We believe Josun’s chances of finishing in a better place were affected and in applying our discretion took into account the following:

--

 

--

1.                  The ground lost by Josun.

--

2.                  The nose margin at the post.

--

3.                  It was clear that Josun had come from a length behind Fistral Bay and was finishing strongly.

--

Accordingly we uphold the protest and the placings shall now be:
