DECISION AND REASONS:

--

Jockey, M Walker, lodged an information alleging interference occurred in the home straight over the final stages of race 9, and COURT THE BREEZE or its rider placed 4th by the judge, interfered with the chances of MILLENNIUM BELLE, placed 5th by the judge. The margin being one and one quarter of a length.

Mr L Casey, the trainer of MILLENNIUM BELLE was present at the hearing. Mr Rayner was not available.

--

Mr Walker demonstrated the head and side-on films and the alleged interference where Mr Calder continued through the gap and dictated his line for 30 metres.

Mr Calder in defence, said at no stage was Mr Walker pushed out by himself and used the film to show where he was inconvenienced more by Mr Walker moving in on him.

Stipendiary Steward, Mr N Goodwin, in summarising said it would be very hard to justify a change of placing on the actions of Mr Calder taking or not taking the line of Mr Walker.

In reaching their decision the committee have taken into account the angled inwards movement by MILLENNIUM BELLE, and the movement out by COURT THE BREEZE onto MILLENNIUM BELLE, and find the contributing factors by both horses to have a major effect on apportioning blame to a single party, least of all Mr Calder. The committee find the sole responsibility for the interference was not by Mr Calder alone, therefore the protest is dismissed.
