Following the running of Race 8, the PGG Wrightson NZ Yearling Sales Series Fillies Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr M. J. House, the driver of "Trinity College", alleging a breach of Rule 857(7)(g). The charge reads as follows.
------"I the abovenamed informant allege that the abovenamed Defendant committed a breach Rule 857(7)(g) in that Mr House failed to come into or maintain his position behind the mobile while driving "Trinity College".
--The rule reads as follows.
--"(7) No horseman shall:-
--(g) fail to come up into and/or maintain his position."
--Mr House had indicated on the information that he admitted this breach
--of the rules. Mr House had not indicated on the information whether he wished to be present at the hearing or not. Stipendiary Steward Mr Ydgren said that when he was advising Mr House of the charge Mr House had stated that he did not want to attend the hearing, but he left before endorsing the Information to this effect. We were satisfied that Mr House did not intend to attend the hearing.
--Video coverage of the start of this mobile 1950 metre race was shown. Mr House started from the outside of the front line. It was pointed out by Mr McIntyre that prior to the start Mr House appeared to make no effort to have his horse up to the mobile starting gate. When the start of the race was signalled Trinity College was two lengths behind the starting gate.
----PENALTY: In relation to penalty Mr McIntyre advised that Mr House had not breached this rule previously. A fine of $200-00 was recommended on the basis that this was a $150,000-00 race, and the fine should be higher for this reason.
--We adjourned and looked at previous penalties imposed for a breach of this rule. The range of penalties was between $100-00 and $200-00, and we were satisfied that a fine of $200-00 was appropriate in this case. Mr House was fined this amount.
