Following Race 4 an information was lodged against Mr TK Allan, rider of VERMONT (Number 8) alleging careless riding (Rule 871(1)(d), namely near the 200 metres causing a sharp check to SIR VALIANT (Number 5).
--| -- DECISION: --Following Race 4 an information was lodged against Mr TK Allan, rider of VERMONT (Number 8) alleging careless riding (Rule 871(1)(d), namely near the 200 metres causing a sharp check to SIR VALIANT (Number 5). ----The defendant, Jockey TK Allan, denied the allegation of careless riding. The informant advised the committee and Mr TK Allan that unfortunately due to technical problems the head-on and rear-on race video footage was unavailable. The informant elected to proceed with the side-on video footage only and the evidence of Mr Peter Johnson (senior rider of SIR VALIANT) and Mr J Oatham (Stipendiary Steward). ----The committee heard from Mr P Johnston. He gave his account of the alleged incident. Mr Oatham gave his interpretation of the alleged incident and demonstrated this on the side-on film. ----Mr TK Allan submitted at the commencement of his evidence that his defence was prejudiced by the unavailability of the head-on and rear-on video footage. He denied his riding was careless and said that he did not move inwards. ----After considering all the evidence and Mr TK Allan's submissions we accept the Mr Allan may be prejudiced in his defence because of the unfortunate unavailability of the aforementioned tapes. Accordingly, in the interests of justice and fairness we dismiss the charge. |
