This is an information instigating a protest filed by Stipendiary Steward Mr J MUIRHEAD on behalf of FAYANNI driven by Mr L CHIN placed 3rd against POCARO driven by Mr M PURDON place second on the grounds that POCARO was not in its correct gait when its nose finished the finishing line and was lapped on by FAYANNI.

Mr PURDON, who is also the trainer of POCARO and Mr T CASEY part owner, represented the connections of that horse.

Mr MUIRHEAD showed the judge’s photo of the finish on a TV monitor. This clearly showed that POCARO was not in its correct gait when its nose reached the finishing line. It also showed that POCARO was lapped on by FAYANNI – the official margin between 2nd and 3rd was half a length. The film of the finish of the race was shown in slow motion. This also showed that POCARO was not in its correct gait when its nose reached the finishing line. Mr PURDON said he believed POCARO broke just after the finishing line.

--The committee is satisfied from both the judge’s photo of the finish and the video film that POCARO was not in its correct gait when its nose reached the finishing line. The horse broke two strides from the finish. POCARO was lapped on by FAYANNI. The rule is mandatory and requires POCARO to be relegated to immediately behind FAYANNI. POCARO is so relegated, the final placings being:-
