Following Race 10 an information was lodged under Rule 858 (4) alleging that the Trainer of Heza Scoundrel omitted the lead bag when saddling that horse.

| -- Following Race 10 an information was lodged under Rule 858 (4) alleging that the Trainer of Heza Scoundrel omitted the lead bag when saddling that horse. --Mr Sharrock admitted the breach. --Mr Hawea told the committee that after unsaddling Heza Scoundrel in Race 10, Mr Du Plesssis noticed that his lead bag was missing and immediately notified the Stipendiary Stewards.An assistant was sent to the stable area whereupon it was found by Mr Sharrock on the floor of the tie-up stall. --Meanwhile, Mr Du Plessis weighed in light at 55.5 kgs after having weighed out for the race at 57kgs. --Mr Sharrock told the committee that while saddling Heza Scoundrel up on his own the horse became fractious and, as a consequence, the saddle and gear were knocked off the side of the stall onto the ground. Mr Sharrock picked the gear up and continued to saddle up unaware that the lead bag was still on the floor. He only discovered the lead bag when the assistant Stipendiary Steward turned up after the race at the stalls. --In relation to penalty Mr Hawea submitted that a substantial fine be imposed because the disqualification affected not only the owners but all the punters who would have been affected by win and place dividends, the quinella, trifecta and the treble. He suggested that a fine under $750.00 would be considered too light. --Mr Sharrock said that it had been a "pure accident" and that there had been no deliberation or neglect. He is also a part-owner of the horse and was devastated by what had happened. --Penalty --The committee had sympathy for Mr Sharrock and agreed that this was an unfortunate incident rather than an act of neglect or any deliberate actions on his part. However Mr Sharrock has clear responsibilities as a trainer and there would have been a great number of people affected by this chain of events. --We took into account all of the submissions and agreed with Mr Hawea that a substantial fine was the appropriate penalty in these circumstances. Accordingly we impose a fine of $1000.00 ---- -- -- --
