Following the running of Race 5, NRM (NZ) Run Free Sires' Stakes Series (Heat 6), an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr C T Dalgety, trainer of ANALYST in the Race, alleging that the front near side hopple came adrift on ANALYST.

DECISION AND REASONS:

--

Following the running of Race 5, NRM (NZ) Run Free Sires' Stakes Series (Heat 6), an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr C T Dalgety, trainer of ANALYST in the Race, alleging that the front near side hopple came adrift on ANALYST.

Mr Dalgety admitted the breach.

Mrs Williams informed the Committee that the hopple on the near fore front came undone and came off the horse's leg, causing the horse to break. Two other runners were checked as a consequence. The three horses lost their chances. ANALYST was second favourite in the Race which was a Sires' Stakes Series heat. Mrs Williams said that the gear did not break ? it came undone.

Mrs Williams showed video replays which showed the hopple come loose between the 1000 and 800 metres.

Mrs Williams informed the Committee that Mr Dalgety had no previous breaches of the Rule in the past 12 months. She recommended a fine of $200.

Mr Dalgety said that he prided himself on presentation and the quality of his gear. The horse was owned by 50 people, of whom about 30 attended the races and viewed the horse prior to the race. He was under pressure, therefore, to present the horse and its gear "one hundred per cent". Mr Dalgety said the horse wore heavy bloomers in the front of its hopples. He is a "mixed-gaited horse" and had gone off stride during the race on two previous occasions. He confirmed that the gear had not broken but had come out of the keeper.

The Committee took into account the submissions of both parties and Mr Dalgety's admission of the breach and his previous good record.

Mr Dalgety was fined the sum of $200.00.
