Following the running of Race 3 an information was lodged by Stipendiary Stewards alleging “Brookfield Banner” broke shortly after the start causing a check to “Tiz A Falcon” which also broke.  Trainer of “Brookfield Banner” K Chittenden advised that the near side hopple had broken causing this incident (faulty gear).

Following the running of Race 3 an information was lodged by Stipendiary Stewards alleging “Brookfield Banner” broke shortly after the start causing a check to “Tiz A Falcon” which also broke.  Trainer of “Brookfield Banner” K Chittenden advised that the near side hopple had broken causing this incident (faulty gear).

The rule was read and confirmed.

Mr T Taumanu, Stipendiary Steward, demonstrated on the films available the evidence where shortly after the start the near side hopple broke on “Brookfield Tanner”, who then checked “Tiz A Falcon”. Mr Taumanu explained to the committee that through the gear breaking the horse then broke, which caused the interference.

Mr Chittenden was charged under Rule 864 (2)d)                                                                                                           
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that-  (d) all gear is correctly applied and/or affixed so as not to malfunction or come adrift.

Mr Chittenden presented the committee with the hopple concerned, and asked them to note the clean break on the gear which he estimated he had used on approximately fifteen occasions. He stated the gear was in very good order and was attached in the correct manner prior to the race; it appears to be just one of those situations that happen to new gear on the odd occasion.

Decision
After inspecting the gear which the committee found to be in near new condition, the clean break on the gear was obvious, and as stated it was attached in the correct manner.

--

The committee find Mr Chittenden has no case to answer and the charge is dismissed.
