Ms Newton admitted a breach of rule 871(1)(d) in race 1 in that she permitted her mount EXACTAMONDO to shift in when not sufficiently clear of SECOND AUDITION ridden by Mr Todd, near the 1900 metre mark. We thus find the charge proved.
----Mr Ching has described the breach as mid range but has said in mitigation that Mr Todd was "trucking up" when Ms Newton came across when she was, at best, a length or a length and a quarter clear. Ms Newton said that she had not realised that Mr Todd was there, but she accepted that she had come across too soon.
----In determining the appropriate penalty we note Mr Todd had to take hold of his mount shortly after the start when Ms Newton came across when only a length or a length and a quarter clear. We give credit for Ms Newton’s ready admission of the breach. As she says, she simply made a mistake. Ms Newton does not have a clear record for this rule, with two breaches this season. So there is no credit to be given in that regard. We see the incident as being mid range, just. However we are concerned by the fact that Ms Newton came across from barrier 4 without apparently looking and when she knew Mr Todd who had drawn barrier 3 was on her inside.
----Mr Ching has asked for a suspension. We believe that a starting point of 5 days is appropriate. In light of Ms Newton’s admission of the breach and the mitigating factor that Mr Todd was hunting his mount up at the very time Ms Newton came across, we believe the matter can be dealt with by way of a 3-day suspension and a fine of $350. Ms Newton is suspended from riding at the end of the Waikouaiti meeting up to and including 9 January 2008. This will permit Ms Newton to ride at the Kumara meeting.
