Following the running of Race 4, the Energy Honda New Plymouth Maiden, M Walker the rider of CLASSIC PRIDE was charged with a breach of Rule 871 (1)(d) ? Careless riding.



Following the running of Race 4, the Energy Honda New Plymouth Maiden, M Walker the rider of CLASSIC PRIDE was charged with a breach of Rule 871 (1)(d) ? Careless riding.

It was alleged that Mr Walker angled his mount out when not clear of FLASH OF DIAMONDS near the 100m mark, resulting in interference to that runner.

Mr Walker, who attended the hearing, admitted the breach.

PENALTY

--

Prior to hearing submissions on penalty Mr Goodwin, with the assistance of Mr McCutcheon, demonstrated the incident by way of the head and side-on films.

These clearly showed CLASSIC PRIDE move out sharply from the rail and into the running line of FLASH OF DIAMONDS with the later having to be checked to avoid heels.

--

Mr Goodwin then presented Mr Walkers record which, notwithstanding a recent suspension, was considered a good one given the frequency of rides that he has.

--

Mr Goodwin submitted that the incident was deserving of a term of suspension.

--

Mr Walker, when addressing the committee, acknowledged his indiscretion however asked the committee to take into account that after he had commenced his outward movement he had attempted to correct his mount when he realised he was going to impede Mr Waddell's horse. However his mount failed to respond quickly enough and as a result he interfered with this runner.

Mr Walker also asked that the committee give consideration to a fine as opposed to a suspension.

--

After carefully considering the submissions of Mr Goodwin and Mr Walker we find that the appropriate penalty in this case is a term of suspension. Breaches of the careless riding rule generally result in a term of suspension and in this case we see no reason for us to vary from this standard.

When determining the quantum to be imposed we have given consideration to the following aggravating and mitigating factors. The aggravating factors being that FLASH OF DIAMONDS has been forced off its chosen line of running at a critical point in the race and as such its chances have been compromised.

--

Set-off against this in mitigation is that Mr Walker has attempted to correct his mount once he has realised his proximity of Mr Waddell however his mount has been unresponsive. Mr Walkers admission of the breach together with his good record over the past twelve months are also factors that afford him some favourable consideration.

Therefore after giving the above factors due consideration we find that Mr Walker be suspended from the close of racing on Sunday 11th of December, up to and including racing on Friday 16th of December which equates to a three day suspension.
