Following race 3 an information was filed pursuant to Rule 411(2) when it was alleged by the informant, Chief Racecourse Inspector J McKenzie that the defendant Ms C Wood committed a breach of that rule.

Following race 3 an information was filed pursuant to Rule 411(2) when it was alleged by the informant, Chief Racecourse Inspector J McKenzie that the defendant Ms C Wood committed a breach of that rule.

The information alleged that the horse KADETRA was entered to start in Race 3 and shown in the official race card as being No.9 in the field. This horse is a bay filly aged 3 years SAN LUIS (AUS) ? MICKLOB and trained by licensed trainer Mr Ralph Manning of Cambridge. The person in charge of the horse at the race meeting, Mrs Colleen Wood saddled the horse OBSCURED, a 3 year old brown gelding KEEPER (AUS) ? MISTY GULCH, entered to race in Race 7 on the card at the same meeting. When the horse OBSCURED was presented at the Plating Inspection and identification area it was found by officials to be the wrong horse and thereby a breach of Rule 411(2) of the Rules of Racing.

Ms Wood admitted the breach.

In his opening remarks Mr McKenzie stressed that although a breach of Rule 411(2) could be classed as a serious racing offence he certainly did not regard this breach to be in that category. This was clearly a case of a person unfamiliar with the horses and making a genuine error of identification.

Mr McKenzie outlined the facts related to the charge and pointed out how Ms Wood, who was assisting trainer R R Manning, had presented OBSCURE to the Plating Inspection and identification area in preparation for a start in Race 3. Through implementing the identification process the error was found as the horse that was entered in that race was KADETRA. This was clearly a case of attendant error.

In admitting the breach Ms Wood said that she had arrived at the Manning stables in Cambridge at 6.00 am and the horses were already on the float and ready to depart.

Ms Wood does not work at the stables and was only involved for the day to assist Mr Manning.

--

As Ms Wood has admitted the breach we are required to adjudicate on penalty only.

--

In submissions on penalty Mr McKenzie again stressed that he did not regard this offence as a severe breach of Rule 411(2). He repeated that he regarded it as a genuine error by a person who was showing true remorse.

He asked for a fine which he felt should be in the vicinity of $500 before taking mitigating circumstances into consideration.

Ms Wood had nothing to add.

DECISION: The committee accepts Mr McKenzie's submissions that in no way could this charge be regarded as a serious racing offence.

It is a serious error through a mistake that has been made by a person who was assisting a trainer for the day and whose first sight of the horse was when they arrived at the racecourse.

--

Ms Wood has shown genuine embarrassment and remorse and immediately acknowledged her mistake.

--

We have taken all matters into account and emphasize that we accept that this was a genuine error. We class it as being a breach at the lower end of the scale and impose a fine of $400.

--

No costs are sought and accordingly we do not make any such order.
