At the meeting of the Rangiora Harness Racing Club on 23rd December 2007 the Stipendiary Stewards lodged an information instigating a charge against Mr McGirr under rule 864 (2) (b) alleging that the shoes on SPIRIT OF OLYMPIA were in poor order and condition.
At the meeting of the Rangiora Harness Racing Club on 23rd December 2007 the Stipendiary Stewards lodged an information instigating a charge against Mr McGirr under rule 864 (2) (b) alleging that the shoes on SPIRIT OF OLYMPIA were in poor order and condition. The relevant rule reads:
--------864 (2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:
--(b) any gear, appliance or device used in a race is of good quality and in good order and condition;
--Mrs Williams, in giving evidence, said that Mr C Markham, the driver of SPIRIT OF OLYMPIA, prior to the start of the race asked that one of the shoes be taken off the horse as he was concerned that it would be thrown during the race.
----Mrs Williams also said that on inspection it was noted that the following issues relating to the shoeing:

- a back shoe put on one front foot ----
- shoes in poor repair with no grip, and ----
- due to the condition they were likely to come adrift during the race. --

The main issue from the Stipendiary Stewards point of view was the safety matter which they emphasised as being important.
----Mr McGirr, in his evidence, accepted that the shoes were in poor repair and that he had replaced a front shoe with a back shoe as the horse was on its second last start and he did not want to incur the expense of having a blacksmith re-shod the horse.
----During his evidence Mr McGirr clearly accepted that the shoes were not in a condition required by the rules and accordingly the breach is found proven.
----In respect of penalty the Stipendiary Stewards recommended monetary penalty only which Mr McGirr agreed with. The Committee, after giving consideration to the evidence presented at the hearing formally finds the charge proven and in respect of penalty imposes a fine of $100.00.
