Decision:

Following the running of Race 4, the Midhurst Holdings  Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr R. N. Lee, the driver of “Atom Of Courage” (13), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.  



Following the running of Race 4, the Midhurst Holdings  Mobile Pace, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Mr R. N. Lee, the driver of “Atom Of Courage” (13), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Mr Lee had indicated on the information that he did not admit this breach of the Rules and he confirmed this at the hearing.  Mr Lee also agreed that he understood the charge and the Rule it was brought under, and also that he understood the “Use of the Whip” Guidelines.

Mr Ydgren gave evidence and used video coverage to show that Mr Lee had used his whip on about 21 occasions repetitively in the run home.  After hearing the evidence from the Stipendiary Stewards, and after seeing the video coverage, Mr Lee elected to change his plea and admit this breach of the Rules.

Penalty:

--

In relation to penalty Mr Ydgren advised that Mr Lee had no relevant previous convictions, and as he had admitted the breach a fine of $200-00 was recommended.  Mr Lee had no submissions to make regarding penalty.

Taking into account the matters put forward by Mr Ydgren we were  satisfied that a fine of $200-00 was appropriate in the circumstances.  Accordingly Mr Lee was fined the sum of $200-00.
