Under Rule 869 (8) at the conclusion of Race 4, the Daphne Cox 90th Birthday Mobile Pace, a protest was lodged by Stipendiary Steward Mrs K Williams, into first place PETRAS STAR, driven by N Williamson, alleging that after approximately 200 metres interfered with BRAHMAN GIRL driven by R Swain, causing that horse to break.

--Mrs Williams stated that in her opinion Mr Williamson had been racing wide on the track and had attempted to ease down, when racing on the outside of BRAHMAN GIRL. As a result of his action Mr Williamson had got his sulky wheel inside the wheel of BRAHMAN GIRL, clipping that wheel causing BRAHMAN GIRL to break and lose ground.
--Stipendiary Steward Mr Knowles used several video clips of the alleged incident, highlighting the horses involved, point of contact and resultant reaction as a result.
--Mr Swain stated that he was entitled to be racing where he was on the track and that he maintained his line. Mr Swain also stated that his horse “did not help” with the alleged interference and contributed slightly by hanging and racing a little greenly. Mr Swain also stated that his horse was not travelling particularly well at the time of the incident and his chances of finishing closer than he did (sixth – 10.4 lengths) from the winner were doubtful.
--Mr Williamson stated that he was entitled to ease down as he was forward of BRAHMAN GIRL, and that his action was normal practice by horsemen in similar situations. Mr Williamson also stated that BRAHMAN GIRL was racing greenly, and that he should have moved down.
--Mrs Williams disputed Mr Williamson’s evidence, stating the he could not move down (Mr Swain) because Mr Williamson’s wheel was inside Mr Swain’s.
--Senior Horseman Mr Larsen, in supporting Mr Williamson, reinforced the point that Mr Williamson in his opinion was entitled to be racing where he was and that BRAHMAN GIRL had contributed to the incident by hanging and racing greenly. Mr Larsen also stated that BRAHMAN GIRL had broken at his previous start.
--DECISION
--The protest was dismissed. After having heard all of the evidence and viewing the video clips of the alleged interference, clearly in my opinion the evidence was inconclusive. Mr Swain, driving BRAHMAN GIRL, by his own admission stated that his horse contributed to the incident, and that his horse was not travelling particularly well, and was hanging at the alleged point of interference.
