Decision:

An Information instigating a protest was   laid by Stipendiary Steward Mr T TAUMANU following the running of Race 7 The Bayleys Real Estate Whitianga (Amateur Drivers) Mobile Pace.

The information was laid on behalf of Horse 4 NO FUSS POPLAR (Driver P CLABBY) placed 4th by the Judge against Horse 3 ALLCLOUT (Driver B HACKETT) placed 1st by the Judge on the grounds of interference allegedly occurring with approximately 450 metres to run.

The information was laid on behalf of Horse 4 NO FUSS POPLAR (Driver P CLABBY) placed 4th by the Judge against Horse 3 ALLCLOUT (Driver B HACKETT) placed 1st by the Judge on the grounds of interference allegedly occurring with approximately 450 metres to run.

Present for the Hearing  were Amateur Drivers Mr P CLABBY (Horse 4 No Fuss Poplar), Mr J NIGRO (Horse 2 Cowdrey), Mr B HACKETT ( Horse 3 Allclout) and Trainer of Allclout Mr K SMITH.
Stipendiary Steward Mr J MUIRHEAD gave evidence of his view from the top of the home straight and referred to video footage.  He identified the runners and indicated where Mr Hackett improving near the turn made a sharp inwards movement with insufficient room, crossing in front of Mr Clabby causing him to take hold and take evasive action.  Mr Hackett had tried to straighten but had acted too late.  It appeared to Mr Muirhead that there had been contact as a result of the movement, following which No Fuss Poplar broke in front of Cowdrey causing both horses to be affected.
Mr Clabby confirmed what had occurred and was sure that there had been slight contact with the legs of No Fuss Poplar and the sulky of Mr Hackett.  His horse was travelling okay and his chances were definitely affected.

Mr Hackett said that he had driven in a fair few races and denied there had been contact but conceded he had “shortened him up”  If had of been able to keep him out the problem would not have occurred.

Mr Nigro could not confirm whether there had been contact but confirmed Mr Hackett’s sudden inwards movement had caused Mr Clabby to take hold and the resultant break had impacted on his drive.  His horse was travelling well at the time.

Decision and Reasons

--

Having viewed the video footage of the race and taken account of the evidence of the Stipendiary Stewards and the various parties the Committee is satisfied that interference was caused to No Fuss Poplar and Cowdrey when Allclout suddenly moved inwards when not sufficiently clear of No Fuss Poplar with approximately 450 metres of the race to run.

--

This interference affected their chances and we find the protest against Allclout is upheld.  Allclout is therefore relegated to finish behind those horses effectively in fifth place

--
