| -- DECISION AND REASONS: --An information was lodged by Stipendiary Steward Mrs K. R. Williams against Mr N. M. Ydgren (Junior Horseman), alleging a breach of Rules 507(2). It was alleged that Mr Ydgren had broken his driving engagement for "Coringa Ruby" at the Wyndham HRC meeting at Wyndham on 14 November 2004. --Mr Ydgren had indicated on the information that he admitted the breach of this rule, and he confirmed this at the hearing. Mr Ydgren is a Junior Horseman and he agreed that he was able to deal with this matter without assistance. --Mrs Williams gave evidence that in Southland a trainer must give the name of a junior driver when nominating a horse for a junior driver's race. Mr Ydgren was asked to drive "Coringa Ruby" and he agreed to do so. Later Mr Ydgren realised that he would have to travel to Wyndham on his own, and that this would be too difficult. Mr Ydgren then told the trainer that he could not drive the horse. Mrs Williams accepted that Mr Ydgren may have been unaware of his responsibilities when taking this drive. --Mr Ydgren did not dispute the evidence. He confirmed that he should have been aware of his obligations when taking this drive, and that he will not make the same mistake in future. --It was also established that a replacement junior driver had been found to take Mr Ydgren's place. --Penalty: --Mrs Williams made submissions that Mr Ydgren had a clear record and recommended a fine of $100-00. Mr Ydgren asked that the fine be less as he was not well off financially. --We adjourned to consider penalty. In reaching our decision on penalty we have taken into account the following matters. ---Mr Ydgren is a Junior Horseman with financial limitations. ---The facts of this matter were unusual and Mr Ydgren is inexperienced. ---Mr Ydgren admitted the breach and was honest about the reasons for breaking this engagement. --Taking all the above matters into account we have decided that Mr Ydgren should be fined the sum of $75-00, and he is fined this amount. ---- -- -- --
