Rule 1001 (1) (R) – At any time uses or permits or causes to be used of who attempts to use or to cause to be used on or in relation to any horse, any electrical, mechanical or galvanic device, equipment, appliance or apparatus (other than that approved from time to time by the board) for the purpose of affecting either at the time of such use or attempted use or subsequently the speed, stamina, courage or conduct of such horse or inflicts undue suffering on a horse by any other means.
--Stipendiary Steward Goodwin asked for a ruling whether the horse ‘Preemo’, carded to race in the 9th race at the Taranaki Racing meeting, should be late scratched. The committee was informed that the device with a battery was noticed in the saddling up area of the horse ‘Preemo’ trained by R. and
Y. Peake.

It was strongly pointed out to the committee that no attempt to conceal the device was made.
--Mr. Peake informed the Stipendiary Stewards the device was used for massage and he has used it on many occasions – on race day, during training and when spelling.
--Further investigations were undertaken and the NZ Thoroughbred Vet was contacted who by way of a phone message confirmed, in his opinion, the device could create an unfair advantage by using it on a horse prior to the race. He believed the horse should be late scratched.
--Mrs. Y. Peake informed the committee that she had no idea it was illegal to use under the rules. The device was used often on their horses and 2 years ago the matter was discussed with the then Chief Stipendiary Steward, Mr. George, and no further action was taken.
--Decision and Reason:
Mrs. Peake, we concur with Stipendiary Steward Goodwin that no attempt to conceal the device was made. Your frank statements on its previous use have been noted. However, the committee is adamant that under Rule 1001 (1) (R) your horse ‘Preemo’ shall be declared a late scratching.
