Following the running of Race 2, Lis Mara Handicap Pace, an information was filed by Stipendiary Steward, Mr J M Muirhead, instigating a protest by UDARE, placed 11th by the judge, against FALCON’S MEDLEY, placed 4th by the judge on the grounds of interference at the start. The allegation was that FALCON’S MEDLEY had broken at the start causing interference to MCALISTER (T W Mitchell) and UDARE (N A Chilcott).

Following the running of Race 2, Lis Mara Handicap Pace, an information was filed by Stipendiary Steward, Mr J M Muirhead, instigating a protest by UDARE, placed 11th by the judge, against FALCON’S MEDLEY, placed 4th by the judge on the grounds of interference at the start. The allegation was that FALCON’S MEDLEY had broken at the start causing interference to MCALISTER (T W Mitchell) and UDARE (N A Chilcott).
--Mr T R Barron, part-owner and trainer of FALCON’S MEDLEY had endorsed and signed the information form “I do not contest the protest”. He was not present at the hearing of the protest.
--Rule 869 provides as follows:
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress of any other horse or horses –
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Mr Muirhead showed video replays of the start of the Race. He pointed out FALCON’S MEDLEY (F D Cooney), drawn No.2 at the start of the 2700 metres standing start event. The horse was fractious at the start, Mr Muirhead said, and when the tapes were released it reared, galloped away and went backwards onto MCALISTER, which had drawn No.1 on the 10 metres mark, and interfered with that runner which, in turn, had interfered with UDARE which had started from 20 metres. UDARE lost all chance and finished in 11th (last) placing. Mr Muirhead sought disqualification of FALCON’S MEDLEY.
--The Committee was satisfied that FALCON’S MEDLEY had clearly interfered with the chances or progress of the two runners referred to in the information and that the chances of, in particular, UDARE had been affected by that interference. UDARE had lost its chance in the Race. The Committee also noted that Mr Barron did not contest the protest.
--Accordingly, the protest was upheld and FALCON’S MEDLEY was disqualified from the Race. Consequent upon the disqualification, the amended result for the Race is as follows:
