Following the running of race 4, Carlton Promotion Sprint, A Calder the rider of GOMAN, provisionally placed 3rd by the judge instigated a protest alleging interference by the winner GO KAY, ridden by B Herd



Following the running of race 4, Carlton Promotion Sprint, A Calder the rider of GOMAN, provisionally placed 3rd by the judge instigated a protest alleging interference by the winner GO KAY, ridden by B Herd, in the final straight. The margins were ¾ length and a nose.

Jockey A Calder, Jockey B Herd, Trainer G Lowry and Trackside presenter J Chan were present at the hearing. The trainer of GOMAN, Mr R James did not attend the hearing. The committee was informed that he was unavailable.

Mr Calder, using the two available films informed the committee that on two occasions in the home straight he believed the winner GO KAY ran out and took his line. On the first occasion GO KAY’S outward movement caused contact and Mr Calder believed he had to pull off and put his horse back on line. He informed the committee that his horse did lug inwards but that he had straightened. On the second occasion he believed his line was taken again by GO KAY’S outward movement.

Mr Lowry, trainer of GO KAY told the committee that GOMAN was lugging in and he felt it had every chance.

Mr B Herd agreed that his horse did move outwards. He believed that Mr Calder did not stop riding. He also believed that GOMAN contributed to the incident by lugging inwards. On the second occasion of the alleged incident he was adamant that his horse maintained his rightful line.

When asked by the chairman if contact was made Mr Herd was unsure.

Both riders were asked at what point and at what distance the alleged incidents occurred. Mr Herd felt that the first incident occurred 250 metres from the winning post while Mr Calder felt the incident occurred at about the 100 metre mark.

Stipendiary steward N Goodwin, under the rules of racing was asked to comment.

He informed the committee that movement outwards from GO KAY did occur but that GOMAN was racing greenly and contributed to the first incident by moving inwards.

DECISION AND REASON

--

Rule 876(!) requires us to ask whether interference occurred and then if so whether that interference has cost the horse interfered with a chance of finishing in a better position

--

We are of the opinion that Mr Calder put his case very strongly and eloquently. The films showed clearly that there was outward movement from GO KAY on two occasions.

--

There does not have to be contact made for interference to have taken place.

--

We were surprised at the two riders interpretation of where the first incident was alleged to have occurred. Mr B Herd felt it occurred at the 250 metre mark while Mr A Calder felt it occurred at about the 100 metre mark. Both available films were unhelpful in pinpointing the point of the alleged interference. Both films showed that movement from GO KAY took place and we were not convinced that contact was made. We were satisfied that GOMAN contributed to the incident by moving inwards and racing a little greenly.

Placings were allowed to stand and the protest was dismissed.
