Decision:

Following the running of Race 10,  the Trax Bar & Café Handicap Rating 70, Ms R. Myers was charged with careless riding under rule 871 (1) (d). The information alleged Rosie Myers the rider of KAAP KRUIS has allowed her mount to shift outwards over the final stages forcing DANIJELA (P. Bell) off its rightful line of running.

Following the running of Race 10,  the Trax Bar & Café Handicap Rating 70, Ms R. Myers was charged with careless riding under rule 871 (1) (d). The information alleged Rosie Myers the rider of KAAP KRUIS has allowed her mount to shift outwards over the final stages forcing DANIJELA (P. Bell) off its rightful line of running.

Ms Myers admitted the breach of the rule and as her employer Mr Breslin had already left the course she was represented by Mr Marshment.

Mr Neal  said that Ms Myers had been pushing her mount along quite strongly over the concluding stages of the race but had let it drift outwards a considerable distance across the track. On two occasions she bumped Mr Bell who was racing to her outside and as a result a protest was lodged.
Despite the significant shift of her mount Mr Neal asked the committee to take into account Ms Myers inexperience and her clear record.
He suggested a term of suspension but put the degree of carelessness towards the lower end.

Ms Myers told the committee that she had begun her apprenticeship on April 1st this year and this was her tenth ride. She said she was completely unaware that she was moving outwards over the concluding stages of the race.
Mr Marshment said it was Ms Myers lack of experience which allowed the incident to happen.

Penalty

In coming to a decision on penalty the committee considered all of the submissions put before it including the fact that Ms Myers admitted the breach.
We also had regard to her inexperience with race-day riding but we cannot place too much emphasis on her clear record after so few rides.
 Mr Neal suggested the carelessness as being at the lower end however we have viewed it as more in the mid- range due to the amount of ground Ms Myers moved outwards,  the subsequent interference suffered by Mr Bell and the lodging of a protest following the race.
It is our opinion that a suspension is the appropriate penalty and Ms Myers notified the committee that she has riding commitments up until Saturday 18th April.

She is therefore suspended from the conclusion of racing on Saturday April 18th until the conclusion of racing on Sunday April 26th.
