Facts:
The informant Mr M Williamson alleged that Mr C Ormsby failed to gain the permission of a stipendiary steward to leave the course after completing his riding engagements.

 

Submissions:
Mr Williamson explained to the committee that following the last race at the Paeroa Meeting on 13 January they required Mr C Ormsby for questioning regarding an incident in the race. However they subsequently found he had left the course without gaining permission from the stewards.

Mr Ormsby in admitting the breach said he was in a hurry to get home to his new property where he was meeting some prospective owners.

He said he completely forgot to get permission to leave.

 

Submissions on Penalty:
Mr Williamson said this was Mr Ormsby’s second charge under this rule this season and he was fined $100 on the first occasion. He said he would leave it to the committee’s discretion on this second charge.

Mr Ormsby did not wish to make any submissions regarding penalty.

 

Reason for Penalty:
In assessing penalty the committee takes into account his admission of the breach but also that this was his second charge under this rule this season. The committee pointed out to him the reasons for this rule being in place.

 

Penalty:
Accordingly we impose a fine of $150.
